Agreement

The following terms and conditions apply to all orders placed with and goods supplied by Paneton Limited (Company).  The Company may alter or replace these Terms and Conditions and our disclaimer from time to time either by written notice to the Customer or by publicising the altered or replaced Terms and Conditions on its website:  www.panetonbakery.co.nz.  All orders placed subsequently by the Customer shall be upon the altered or replaced terms and conditions.

Any reference to “Paneton”, “we”, “our” or us” in these terms and conditions shall mean Paneton Limited.

By using the Paneton website, you are deemed to accept the “Terms & Conditions” of sale.  If you are NOT able to agree to any aspect of this policy, please do not use the Paneton website.

Pricing

Prices displayed on the website are in New Zealand dollars ($NZ).  Prices displayed include GST (15%).

All prices are correct at time of publication,  however, we reserve the right to alter the price for any reason.  If this happens with an item you have ordered, we will contact you prior to delivery.

Force Majeure

The Company shall not be liable to the Customer for any loss or damage directly or indirectly arising out of or in connection with any delay in delivery of the goods, or failure to perform any of its obligations where such delay or failure is caused directly or indirectly by an act of God, fire, armed conflict, labour dispute, civil commotion, intervention of a government, inability to obtain labour, materials or facility and accidents, interruptions of, or delay in transportation or any other cause beyond the failure to perform any of its obligations due to causes beyond its control.

Governing Law

This site and these Terms & Conditions shall be interpreted in accordance with and governed by the laws of New Zealand.

Privacy Policy

At Paneton we are committed to protecting your privacy.  We recognise that your personal information is confidential, and we understand that it is important for you to know how we treat your personal information.  We hold all personal information subject to the Privacy Act 1993 and the terms in this Privacy Policy as set out below.  Please read on for more information about our Privacy Policy.

This Privacy Policy applies to all personal information collected by us about you through our website.  Paneton does not collect personally identifiable information on our website, such as your name, address, email address or telephone number without your knowledge.  Such information is collected only when you knowingly and voluntarily submit it to us (as, for example, when you contact us via email).  Paneton uses this voluntarily submitted information for the purpose for which it was submitted.

Tracking and Sharing

Paneton uses standard software for monitoring statistical information such as how many visitors we have to our website and what countries they are coming from.  These statistics are viewed on an aggregate basis and help us get general overviews of customer trends.  We do not look at individual customer data.  Personal information specific to each sale is treated as strictly confidential and will only be reviewed or examined in the event of a dispute, claim, error or customer request.  We never share, sell or trade individual personal information with anyone without your advance permission or unless ordered by a court of law.

Security

Paneton uses stringently tested technologies to ensure the security of information transmitted via our website and maintained in our possession.  When you place a credit card order through the site your details are transmitted over a secure server.  All details are encrypted before being transmitted using a fully PCI DSS compliant card authorisation system and payment processing service.

Cookies

Cookies (or small text files) allow Paneton to remember you.  If we didn’t use cookies, you would have to enter your details each time you visited.  If you really prefer not to use cookies, you can set your browser preferences to not accept cookies.  Most websites, however, including Paneton’s, require cookies to process your orders.

Conflict

In the event of any conflict between the terms of any product list or order confirmation or other communication and these Terms and Conditions, the express provisions contained in the product list or order confirmation or other communication, as the case may be, shall prevail.  These Terms and Conditions shall prevail over the Customers terms and conditions (if any).

Intellectual property rights

Copyright of all text, images, graphics, layouts, logos and designs used in this website is owned or licensed by Paneton Limited.  You may access material from this website for personal use and not for any commercial purpose.  You are not permitted to publish, manipulate, distribute or otherwise reproduce, in any format, any of the content or copies of the content supplied to you or which appears on this website nor may you use any such content in connection with any business or commercial enterprise.

Delivery

Standard delivery will be within three working days.  If, for any reason, we are unable to process your order due to insufficient courier charges being assigned at checkout, we will contact you to arrange additional charges.  An additional fee may apply if the original address provided by you is incorrect or the courier is unable to access the address due to gates, buttons etc. so please be sure all the details for delivery are correct to enable delivery to be made efficiently.

We may also be able to arrange next day delivery (for Auckland customers) to one of our retail outlets if requested and we receive your order before 12 midday on day before delivery.

Please note that all prices are quoted in NZ dollars ($NZ)

A signature may be required for delivery or we may require instructions as to where  goods may be delivered safely.

We are unable to accept a PO Box as a delivery address.  It is possible to deliver to a work address but please state delivery hours and all necessary information such as building number, level or office name.

If  by any chance one of the products you would like to order is out of stock, we will inform you at the time of ordering.

We aim to process all orders with 24 hours of receipt.  Orders are processed and shipped during regular business hours (Monday through Friday 8-4pm), excluding Public Holidays).   Your order should arrive within 2-3 working days.  If we encounter any problems processing or shipping your order you will be contacted within two days.  Any orders being delivered to rural addresses can take a little longer due to the infrequent schedules of Rural Couriers and we cannot guarantee the exact day or time of delivery.

If you have not received your parcel within 5 days please contact us.

Please be aware that at peak times (e.g. Christmas etc.), deliveries may take slightly longer due to the volume of freight moving around New Zealand. 

We are not able to freight internationally.

Risk in the goods shall pass to the Customer upon delivery.  The Company will have no liability in the event that the goods having been delivered are lost, stolen, destroyed or damaged in any way from any cause whatsoever nor shall the Customer be entitled to refuse or delay payment for the goods.

Payment

Payment may be made by Credit card or direct credit via your Bank.

Paneton will appear on cardholder statements for any payments made via the DPS payment gateway on this website.

You will be liable for all orders placed using your credit card details and agree to indemnify Paneton against any losses, claims or damages arising from the use or misuse of your credit card details by any other person.

Indemnity

By accessing our website, you agree to indemnify and hold us harmless from all claims, actions, damages, costs and expenses including legal fees arising from or in connection with your use of our website.
